Week 7- Module 7 - Part II - Q&A Response

 Larry Feirman State & Local Government February 25, 2021 Module 7- Assignment 7 Q: This week, please read and reflect on Chapter 3, State Constitutions. Find and summarize an example of an effort to update or challenge a state constitution… it can be any state in the US and any time, recent or not. Your summary must demonstrate that you have read the chapter in your textbook and are applying that text’s concepts as you learn about the example you are summarizing. You can most effectively do this by making direct references to the concepts and information found in your textbook and relating them to the details about the real-life example you summarize. A: The California Constitution is in many ways a textbook example both good and not so good based on Chapter 3 details.  In Part III of my response, I have captured the changing laws for thew California Constitution for 2021.  It is detailed voluminous, and in the final part some very silly and ridiculous s...

These laws could have the biggest impact on the greatest number of Californians. Module 7 - Week 7 - Part I - Chapter review- Notes

Lawrence (Larry) E. Feirman State & Local Government February 25,2021 Module 7- Week 7 Assignment Highlights of Chapter  • State Constitutions represent “Fundamental Law” (set of rules or superior to statutory law.  Those who master the regulations and procedures have a distinct advantages over novices. • In the US system of dual constitutionalism – powers granted to the national govt. are denied to the state, although national constitution is incomplete, leaving many issues to the state, especially pertaining to finances, public education, and the organization of state & local government. • In theory state constitutions are supreme for all matters not expressly within the jurisdiction of the national government, but congressional actions have expanded the powers of the natl. government. • State constitutions are a mine of democratic communities.  They are distinctive in history design, and underlying premises. • Through constitutional reform...

Week # 6 Assignment- Blog Entry #9

 Larry Feirman State & Local Government February 19, 2021 Week 6 || Blog Entry #9 I believe it was in the fall of 2009, the recession was in full swing and job losses were over ½ million.  I was actually out of work that year due to a layoff and depressed business trade.  The economy had people angry and upset.  This was a major upset that had not been seen in years. With directives from the U.S. Government, a major influx of money and assistance to help those who were suffering due to the collapse was enacted. As an example, in California, assistance was available through a plan “Keep Your Home California”.  It was a lifesaver for many. The Federal government saved the auto industry, banks, insurance companies, et. Across the U.S. there were organized “Tea Parties” to halt the likes of Obama Care (The Affordable Care Act-ACA), control the deficit, and prevent the Federal Government from deciding what industries to save, not save.  The ...

Module 5 - Week 5 || Blog Entry #8 - Subsidiarity & Devolution

Image
 Larry Feirman State & Local Government-PSC2301-C February 10, 2021 Module #5 - Week#5-Blog Entry #8 Part 1 From the PowerPoint handout it is clear that the principal of subsidiarity of communities, groups of people, that could be described as families, neighborhoods, collectives, and then from there larger national organizations and possibly international institutions. The takeaway from this principal is this: that the higher-level entity should not infringe upon the life of a community at the lower level of that entity.  The larger institution is to support the smaller, local entities, especially when providing essential human needs and rights.  The foundation to all of this is to support the common good. It is one thing to speak of and understand subsidiarity, yet another to put into action, that is a personal commitment to take action.  This action begins at the local level, within our town, county, state.  Local is always a sound plac...

Blog #6 - Response - My Community Partner

 Larry Feirman State & Local Government February 4, 2021 Assignment- Blog #6 Blog #6 Your Community Partner organization is probably, on some level, solving a perceived problem that exists at a state or local level. Service delivery relating to homelessness, food insecurity, academic progress, childcare, discrimination, job training, interview preparation, day worker safety, environmental problems, and so much more are all examples of functions that state or local governments might attempt to address, and community organizations are often the means by which they address them.  Q: What problem(s) is your Community Partner (CP) trying to address? How can members of the community in which it operates help through their participation? In what ways does this serve an end of a local government entity? Use conversations with your CP if you can, along with the concepts outlined in your textbook to answer these questions.   Project READ fuels the fire of hope t...

Blog entry #5: Response

 Larry Feirman State & Local Government January 31, 2021 Week 3- Module 3 - #5 Blog entry #5: Read and reflect on Chapter 10 of your textbook, State-Local Relations.  Q: Why is there tension between the state and local levels of government A: There are a number of issues, laws and rules that create and exacerbates the situation between state and local governmental domains.  Following the outline of our textbook, the first issue would be the “Distribution of Authority”.  Dillion’s rule of 1868, established that local government may exercise only those powers explicitly granted to them by the state, those clearly implied by these explicit powers, and those absolutely essential to the declared legality of a specific local government power…..” It goes without saying that when one’s authority or power is limited or directed from a hierarchal body, there is bound to be issues.  There is most always a matter of interpretation on the part of local ent...
